Dear Mr. and Mrs.[redacted]:
This firm is legal counsel to 2422 East 4th Street, L.L.C., an Arizona limited
liability company ("Landlord"), and its managers, Mr. and Mrs. Lehrer. We understand you are former tenants of Landlord, specifically Unit [redacted] of 2422 East 4th Street, Tucson, Arizona. We are also in receipt of a number of postings you have made through various social media outlets, including Craigslist and Yelp, about Landlord and its managers. We have been retained to address and remedy the torts you have Committed against our clients and the damages you have caused. Be advised that the facts contained in your postings are demonstrably false and the legal conclusions are. incorrect. We will not spend the time refuting each misstatement and lack of understanding of Arizona's Residential Landlord and Tenant Act; suffice to say that the statements constitute defamation per se and false light in violation of Arizona law.
Accordingly, demand is hereby made for you to immediately contact the websites
and remove the postings and cease and desist any similar action, including, but of course not limited to, defaming Landlord and its managers on the internet, other media outlets, and to third parties directly. This would include taking such action directly (anonymously or not) and/or doing so on behalf of another or assisting another person to do so. We are closely monitoring the internet, including various University of Arizona websites, for additional evidence. We will continue to do so and if you choose not to stop this course of action, our clients intend to exercise their legal rights and remedies, which will include a lawsuit in the Pima County Superior Court for defamation,intentional interference with business, false light, and intentional infliction of emotional distress. In connection with that suit, we will seek compensation for the damages you have caused, not the least of which are loss of tenants, as well as attorney's fees and costs. Whether our clients are forced to take further legal action is entirely within your control, and thus I expect the current postings will be removed and there will be no additional postings or statements about Landlord or its managers. I hope this matter is now resolved and look forward to your cooperation in this regard.
